Data processing (purpose and legal basis)

User data (first name, last name, position, photo, email address, cell phone number, smartphone operating system) and communication data (e.g. browser information, IP addresses, access times, subpages visited and user actions) are processed as a matter of principle.

User data is processed for the purposes of providing the service and is based on Art. 6 (1) (b) of the GDPR or on Art. 6 (1) (a) of the GDPR, insofar as the information is provided voluntarily by the user and is not necessary for the specific provision of the PDC service. The user data is stored for billing and verification purposes for up to one year after the end of the contract term. Longer storage periods may apply to individual pieces of data due to legal requirements. No data shall be disclosed to other service providers unless we are legally obligated to do so or are required to do so by an official or court order. The device manufacturers, operating system manufacturers and other data processors are responsible for the data processing operations involving the pass on the smartphone in question in the context of smartphone operation. If we do not obtain the data directly from the data subject, it is the responsibility of the party providing the data to ensure that a suitable basis for permission to process the data exists.

If user data is processed on behalf of a reseller or direct customer, then this reseller or direct customer is the controller as defined under the GDPR. In this case, processing is performed as contract-based processing for the Elatec reseller or direct customer pursuant to Art. 28 of the GDPR. User data is also processed by Elatec GmbH for the purposes of statistical analysis pursuant to Art. 6 (1) (f) GDPR and passed on in order to fulfill obligations towards mobile device operating system service providers pursuant to Art. 6 (1) (b) GDPR and Art. 6 (1) (f) GDPR.

 

Communication data is processed to ensure integrity and confidentiality and is based on Art. 6 (1) (f) of the GDPR. This data is stored for a period of six months after creation. This service alerts the operator to the fact that your IP address has been used to access our website.
